Kentish Draft Local Provisions Schedule

At its December 2023 Ordinary Meeting, Council considered the representations made during the public exhibition of the Draft Local Provisions Schedule and endorsed its report under Section 35F of the Land Use Planning & Approvals Act 1993. The endorsed report and representations are forwarded to the Tasmanian Planning Commission (TPC), ahead of the TPC hearings scheduled for 16 – 19 April 2024 at the Kentish Council chambers.

EXHIBITION NOTICE – INVITATION FOR WRITTEN REPRESENTATIONS

The Kentish Council invites written representations on the relevant exhibition documents in relation to the Kentish Draft Local Provisions Schedule (LPS).  The Tasmanian Planning Commission (the Commission) has directed the planning authority to publicly exhibit the Kentish draft LPS under section 35B of the Land Use Planning and Approvals Act 1993 (the Act).

The relevant exhibition documents can be viewed or downloaded by clicking on the links below or viewed during normal business hours at:

  • Kentish Council offices, Monday to Friday (by appointment) at 69 High Street, Sheffield; and
  • the Tasmanian Planning Commission’s offices from 9am until 5pm, Monday to Friday at Level 3, 144 Macquarie Street, Hobart.

The period for lodging a representation runs from Monday 8 May 2023 until Friday 7 July 2023. Under the Act, Council cannot accept any representations outside of this time period.

Making a Representation to the Draft Kentish Local Provisions Schedule

The Act requires that certain parts of the Tasmanian Planning Scheme cannot be the subject of a representation. These are:

  • The State Planning Provisions;
  • Provisions that are carried through from the Kentish Interim Planning Scheme 2013. The Draft LPS must contain the particular purpose zones, specific area plans, site-specific qualifications and code-applying provisions specified in the transitional provisions under Schedule 6 of the Act, declared by the Minister for Planning. The transitional provisions cannot be the subject of any representation to exclude them.
  • Prior approved amendments to the Kentish Interim Planning Scheme. Prior amendments can be viewed on the Commission website at www.planning.tas.gov.au or the Austlii website at www.austlii.edu.au.

The Tasmanian Planning Scheme

The Tasmanian Planning Scheme (TPS) will apply across the whole State.  It will replace the current planning schemes that operate in each Council area.  The TPS is made up of the State Planning Provisions and a Local Provisions Schedule for each council area.

State Planning Provisions

The State Planning Provisions (SPP’s) were made by the Minister in February 2017 with minor amendments in April 2018.  The SPP’s set out the way the planning scheme operates, the zones that can be applied to land and the planning rules for use and development that occurs within those zones. The intent of the Tasmanian Planning Scheme is to achieve as much consistency as possible in the planning rules that apply across the State.

Local Provisions Schedule

The Local Provisions Schedule (LPS) requirements are set out in the State Planning Provisions and are part of the legislated framework. The LPS is made up of;

  • The zone maps
  • Local Area objectives (LAO’s)
  • Particular Purpose Zones (PPZ’s)
  • Specific Area Plans (SAP’s)
  • Site Specific Qualifications (SQQ;’s)
  • Code overlay maps (prescribed and local data)
  • Code Lists

Transitional Provisions

The Draft LPS includes a specific area plan and scenic overlay at Cradle Mountain that is currently operating in the Kentish Interim Planning Scheme 2013. These provisions have been approved by the Minister for Planning to transition into the Draft LPS under Schedule 6 of the Act and must be included in the Draft LPS.
